MARIE FAILINGER
Interim Dean and Professor of Law, Hamline University School of Law
Marie A. Failinger is the interim dean and a professor of law at Hamline University School of Law. She is the former editor of the Journal of Law and Religion and the co-editor of Feminism, Law and Religion, and a forthcoming collection on Lutheran theology and secular law. A former Legal Services attorney, she has also been active on nonprofit Boards of Directors and committees providing legal services to the poor and advancing the concerns of American Indians, civil rights for Muslim Americans, women and the law, adoption, church outreach, arts and the law, and others. She has a J.D. and an honorary doctor of laws from Valparaiso University School of Law, and an LL.M. from Yale Law School.

TIMOTHY J. TRACEY
Associate Professor of Law, Ave Maria School of Law
Tim Tracey is an Associate Professor of Law at Ave Maria School of Law in Naples, Florida. He teaches First Amendment, Constitutional Law, and Contracts I and II. He is a former litigator for the Christian Legal Society and the Alliance Defending Freedom in Washington, D.C. He has litigated numerous First Amendment free speech and religious liberty cases, including Christian Legal Society v. Martinez. His scholarship focuses on the intersection of law and religion. Most recently, he published a chapter concerning the treatment of religious worship under the First Amendment in the book, American Law from a Catholic Perspective: Through a Clearer Lens. He is a graduate of Grove City College and Wake Forest University School of Law. He lives with his wife and two sons in Fort Myers, Florida.
SHAWN M. CRINCOLI
Professor of Law, Touro College Jacob D. Fuchsberg Law Center
Shawn Markus Crincoli is an Associate Professor of Law at the Touro College Jacob D. Fuchsberg Law Center, and he is currently enrolled at the California Institute of Integral Studies as a Ph.D student in Human Sexuality. He has written and lectured on a wide variety of subjects including: the intersection of law, LGBTQ rights & religion; transgender health and the law; gender & disability in sport; regulation of the family; Jewish law; LGBTQ cultural competency; and more. Professor Crincoli, a member of the National LGBT Bar Association, currently serves: as the Chair of the Legal Issues committee of the World Professional Association for Transgender Health (WPATH); on the advisory board of #BornPerfect: The Campaign to End Conversion Therapy for the National Center for Lesbian Rights (NCLR); and as a Researcher for the Williams Institute studying data collection of LGBTQ bias motivated crime.
Professor Crincoli received his J.D. with high honors from the University of Chicago Law School in 2000. From 2001-2007, he was a faculty member at the University of Minnesota School of Law. Before joining the Minnesota faculty, he clerked for Chief Judge Richard A. Posner, United States Court of Appeals for the Seventh Circuit.
MARY ANNE CASE
Arnold L. Shure Professor of Law, The University of Chicago Law School
Mary Anne Case is a Professor of Law at the University of Chicago Law School. She teaches feminist jurisprudence, constitutional law, European legal systems, marriage, and regulation of sexuality. While her diverse research interests include German contract law and the First Amendment, her scholarship to date has concentrated on the regulation of sex, gender, and sexuality, and on the early history of feminism. She is a graduate of Yale College and Harvard Law School. She also studied at the University of Munich; litigated for Paul, Weiss, Rifkind, Wharton and Garrison in New York; and was the Class of 1966 Research Professor of Law at the University of Virginia before joining the University of Chicago Law School faculty. She was a Visiting Professor of Law at the University of Chicago Law School in autumn of 1998 and at New York University during the 1996–97 academic year and the spring of 1999. In the spring of 2004, she was Bosch Public Policy Fellow at the American Academy in Berlin. For the 2006– 07 academic year she was the Crane Fellow in Law and Public Affairs at Princeton University.

This panel includes topics exploring the relationship between gender and religion. Professor Marie Failinger will analyze the Free Exercise clause in the Constitution through the values found in feminist jurisprudence. Also, Professor Shawn M. Crincoli will contrast how different religious denominations view assigning and reassigning sex, including how sex assignment is viewed under the American legal system. Professor Timothy J. Tracey will explore whether stripping private schools of their tax exempt status is constitutionally permissible if they maintain an opposition to same-sex marriage.
